This bill establishes a right to representation for college students and officially recognized student organizations in certain non-academic disciplinary proceedings where the potential punishment includes suspension for 10 or more days or expulsion. Students and organizations can choose to be represented by a licensed attorney or a non-attorney advocate at their own expense, and this representative can fully participate in the proceedings, which include investigatory interviews or hearings. This right also extends to both accused students and student complainants in cases involving student-against-student complaints that carry significant disciplinary consequences. Before questioning a student about potential violations that could lead to suspension or expulsion, the university must inform them of their rights under this act. The bill specifically excludes academic dishonesty allegations and does not mandate representation at public expense. Furthermore, it requires institutions to immediately notify relevant authorities and the student if exculpatory evidence is discovered during an investigation or charge related to a crime. If a student or organization believes this act has been violated, they can sue in Massachusetts Trial Court and may be awarded compensatory damages, court costs, attorney fees, and other relief, including a new hearing, with a one-year statute of limitations from the final disciplinary notice.
