This bill amends Section 42 of Chapter 166 of the General Laws to allow municipal lighting plants, which are publicly owned utilities that provide electricity, to remove, move, or relocate poles, wires, cables, and other apparatus belonging to any person or entity upon the request of a public safety official in a city or town with such a plant. Importantly, the municipal lighting plant and its workers will not be held responsible for any damages to people or property that occur during this process, including damage to the equipment itself. Furthermore, if the owner of the equipment is notified and fails to respond within two hours, or if there is an emergency as determined by the public safety official or municipal lighting employee, the municipal lighting plant can charge the owner for all costs associated with the removal, moving, or relocation, and the owner will have 30 days to pay the invoice.
