This bill clarifies the site assignment process, specifically concerning noise from public events. It amends Chapter 111 of the General Laws by adding a new section that exempts parades, public gatherings, and sporting events that do not involve motorized racing from requiring a site assignment if the only reason an assignment would be needed is due to the sound produced, provided all other necessary local permits have been obtained. Furthermore, the bill states that sound emitted from these types of events will not be considered a nuisance or air pollution. It also explicitly defines "sporting event" for the purposes of the Massachusetts Department of Environmental Protection (DEP) regulation 310 CMR 7.1 (3) (a) as an event that does not include motorized racing, and notes that the Seekonk Speedway, having opened before the DEP's noise regulations, is exempt. Importantly, this act does not prevent cities or towns from enacting their own local laws regarding noise, air pollution, or regulating competitive motorized racing events.
