This bill aims to ensure equal treatment for mental health and substance abuse services compared to other medical services by allowing individuals to sue in Superior Court if they believe their insurance plan is not providing this parity. If a court finds a violation, the person who brought the lawsuit can recover triple the damages, court costs, and attorney fees, along with any other relief the court deems appropriate. The bill also permits individuals to bring lawsuits on behalf of a group of people who have experienced similar denials of care, provided the court agrees that the individual adequately represents the group, and requires that all members of the group be notified of the lawsuit, which cannot be dismissed, settled, or compromised without court approval.
