This bill, the "New Jersey Safe and Responsible Driver Act," establishes a new type of driver's license for individuals who meet the requirements for a basic driver's license but cannot provide proof of lawful presence in the United States. Applicants will need to provide proof of identity, date of birth, and New Jersey residency, with the Motor Vehicle Commission (MVC) determining acceptable documentation, which can include various forms of identification and residency proofs. A fee, not exceeding $50, may be charged to cover administrative costs for the first 36 months, after which standard fees will apply. Providing false documentation or making false statements on an application will be considered falsifying government records. Licenses issued under this act will be valid for four years and grant the same privileges and responsibilities as a basic driver's license, and discrimination against individuals holding these licenses is prohibited and carries penalties for both individuals and public officials. The licenses will include a digitized picture and a statement indicating "Federal Limits May Apply," and personal information collected will not be considered public record and will have strict disclosure restrictions, preventing its use for investigations, arrests, citations, or detentions without probable cause or a warrant. The MVC will also conduct a public education campaign about these new licenses.
