This bill establishes regulations for the use of automated license plate readers (ALPRs) by law enforcement agencies, defining an ALPR as a system that automatically captures images of license plates and vehicles, converts them to text, compares them to programmed lists, and alerts law enforcement to matches, whether stationary or mobile. Unauthorized access or use of ALPR data by agency employees will be considered a disorderly persons offense, a minor criminal offense. The County Prosecutor or Attorney General will conduct annual audits to ensure ALPRs are used solely for official law enforcement purposes. Furthermore, agencies using ALPRs must submit annual reports to the Attorney General detailing the number of readers, readings, stored data, data requests and releases (including out-of-state and federal requests), and any data breaches, with the Attorney General then issuing a summary report to the Governor and Legislature. Importantly, stored ALPR data cannot be destroyed and will only be accessible to law enforcement during the statute of limitations for an investigated offense.
