This bill, titled "Relative to healthy youth," amends Chapter 71 of the General Laws to establish new requirements for sexual health education in public schools. It defines "age-appropriate" as suitable for a child's developmental stage, and "medically accurate" as supported by scientific research and recognized by leading health organizations. The bill mandates that any school district or public school offering sexual health education must provide instruction that is both medically accurate and age-appropriate, covering the benefits of abstinence and delaying sexual activity, the importance of contraception and barrier methods for preventing unintended pregnancies and sexually transmitted infections (STIs) like HIV/AIDS, skills for safer sexual activity, and the development of healthy, respectful relationships free from violence. It also specifies that this education must be inclusive of all students regardless of gender, race, disability, or sexual orientation. Schools that follow the Massachusetts comprehensive health curriculum framework will be presumed to be in compliance. Additionally, the bill revises existing law regarding parental rights in sexual health education, requiring school districts to adopt policies that ensure parents are notified about comprehensive sexual health education, have the right to withdraw their child from all or part of the instruction, and can inspect program materials beforehand. This notification must be provided in English and the parents' native language, distributed annually by September 1st, and a copy sent to the Department of Elementary and Secondary Education. Students withdrawn from instruction will not face disciplinary action and must be offered an alternative educational activity.
