This bill requires hospitals to develop and implement a staffing plan to ensure sufficient and qualified registered professional nursing staff at all times to guarantee patient safety, with specific nurse-to-patient ratios for various hospital units, such as intensive care (1:1), emergency departments (1:1 for critical care, 1:3 for non-critical), and medical/surgical units (1:4). To create these plans, hospitals must establish staffing committees for each unit, with at least half of the members being direct care registered professional nurses (R.N.s) from that unit, and these committees will determine staffing strategies if patient needs exceed minimum ratios. The bill also mandates that these minimum ratios must be maintained at all times, prohibits averaging staff or patients to meet ratios, and restricts mandatory overtime except in unforeseen emergent situations, defining terms like "acuity tool" (a system to assess patient care needs) and "department" (the department of licensing and regulatory affairs). Hospitals have a set timeframe to develop and submit their plans, and they must maintain records of actual staffing ratios, post information about patient rights and complaint procedures, and face administrative fines for violations, with the department responsible for investigating complaints and promulgating rules to implement these provisions.
