This bill authorizes the town of Acton to issue sixteen additional licenses for the sale of all alcoholic beverages and six additional licenses for the sale of wines and malt beverages, which are to be consumed on the premises where sold. These licenses will be granted under specific provisions of Massachusetts General Laws, chapter 138, which governs alcoholic beverages, and will be subject to the requirements of chapter 140, section 2, meaning establishments must also hold a common victualler's license, which permits the sale of food. Importantly, for a period of three years after issuance, these new licenses cannot be transferred to a different person or entity, though they can be reissued at the same location to a new applicant if that applicant demonstrates they are in good standing with the Department of Revenue and the Department of Unemployment Assistance by providing letters confirming all taxes, fees, and contributions have been paid. If a license is canceled, revoked, or no longer in use, it will be returned to the licensing authority, which can then grant it to a new applicant under the same conditions, provided the new applicant also meets the tax and contribution requirements.
