This bill establishes new protections for consumer data collected by motor vehicle dealers, defining "consumer data" as nonpublic personal information provided by a dealer to a licensee (such as a manufacturer or distributor) or a third party acting on their behalf, excluding data obtained by the licensee from other sources. Licensees and third parties must adhere to federal and state laws regarding the reuse or disclosure of this data and, upon a dealer's written request, provide a list of all consumer data obtained and to whom it was disclosed within the past six months, with certain exceptions for service providers or when the dealer has already consented. The bill also prohibits licensees from requiring direct access to a dealer's data management system, which is defined as any computer system used by the dealer to store and access consumer data, unless the dealer provides separate written consent that can be withdrawn. Furthermore, licensees are required to indemnify dealers for any claims or damages arising from violations of these data protection rules.
