This bill declares that oil and gas exploration and production activities, which encompass a wide range of actions from surveying and drilling to operating wells and transporting products, are presumed to be reasonable and do not constitute a nuisance unless they have a substantial adverse effect on public health and safety. Furthermore, if these activities comply with all federal, state, and local laws and regulations, they are automatically considered good practices and not harmful to public health and safety. The bill also prevents nuisance lawsuits against oil and gas operations that have been active for two years or more, even if the facilities are expanded or new technology is adopted, as the original date of operation is maintained. Finally, if a court finds a nuisance lawsuit related to these activities to be frivolous, the defendant (the oil and gas operator) will be awarded their reasonable costs, expenses, and attorney fees. The bill includes an emergency clause, meaning it will take effect immediately upon passage and approval to address an urgent need for public peace, health, and safety.
