This bill amends the Public Works Minimum Wage Act to clarify how prevailing wage and fringe benefit rates are determined for public works projects in New Mexico, excluding contracts for public roads and educational institutions. The director will now determine these rates through a statewide field survey and by encouraging voluntary submissions from various stakeholders, calculating the weighted average of wages paid for similar work, with the stipulation that New Mexico's rates will not exceed those set by the federal Davis-Bacon Act. The bill also grants the director enhanced enforcement powers, including the ability to issue subpoenas and temporarily withhold payment assurances if there's probable cause to believe a violation of the act has occurred, and specifies an effective date of July 1, 2016.
