This bill amends Section 13-1-119.2 of the New Mexico Statutes Annotated (NMSA) 1978, which deals with procurement methods for transportation projects. Specifically, it allows the New Mexico Department of Transportation to use a "design and build" project delivery system for projects that cost more than $50,000,000 and are funded, at least partially, by federal-aid highway funds. The "design and build" system is a method where a single contractor is responsible for both the design and construction of a project, which is a change from traditional methods where design and construction are handled by separate entities. This provision overrides any existing prohibitions on using this method for road and highway construction or reconstruction projects as outlined in Section 13-1-119.1 NMSA 1978.
