This bill establishes a new "Beer and Wine Delivery License" that local option districts can approve through an election, allowing restaurants or food delivery services to sell and deliver beer and wine alongside prepared food, with specific limits on the quantity of alcohol per delivery. To qualify, applicants must demonstrate that their primary revenue comes from food sales, and renewals will require at least 70% of gross receipts from delivery operations to be from prepared food. Deliveries are restricted to private residences or lodging units, must cease by 10:00 p.m. (or 9:00 p.m. on Sundays), and cannot be made to designated "do not deliver" addresses or within 300 feet of schools or youth centers. Delivery personnel must be certified alcohol servers, and all transactions must be electronic, with records maintained for at least five years. The annual fee for this license is $1,300, and it is exempt from the general limitations on the number of licenses issued in a given area.
