Bill Summary
To amend title 10, United States Code, to ensure that certain members of the National Guard serving on full-time National Guard duty and dependents remain eligible for the TRICARE program during periods in which the member is responding to a disaster. This bill makes eligible for TRICARE health care benefits certain National Guard members (and dependents) who are performing disaster response duty, if the performance of such a duty immediately follows a period in which the member served on full-time additional National Guard duty. "Disaster response duty" means duty performed by a member of the National Guard in state status pursuant to an emergency declaration by the state governor (or, for the District of Columbia, by the mayor) in response to a disaster or in preparation for an imminent disaster.
AI Summary
This bill amends Title 10 of the United States Code to ensure that certain members of the National Guard and their dependents continue to receive healthcare benefits through the TRICARE program, which is a health care program for uniformed service members and their families, even when they are responding to disasters. Specifically, it allows National Guard members who are performing "disaster response duty" – which means duty in a state status due to a governor's emergency declaration in response to or preparation for a disaster – to be considered on active duty for more than 30 days for TRICARE eligibility purposes, provided this disaster response duty immediately follows a period of full-time National Guard duty. The bill also states that states will be charged for the costs of this extended TRICARE coverage for their National Guard members and dependents, with these payments being credited to the Defense Health Program Account.
