This bill amends existing laws concerning endangered and threatened species by defining "to take" as an act or omission resulting in the death of such a species and by establishing new provisions for authorized activities. Previously, exceptions for taking endangered or threatened species were limited and primarily handled by the commissioner. Now, a new section, 12 MRSA §12808-A, allows the commissioner to authorize activities for educational, scientific, or conservation purposes, as well as for the transportation of these species. Crucially, it introduces a framework for "incidental take plans," which are detailed plans developed by individuals or the commissioner to manage situations where otherwise lawful activities might unintentionally result in the taking of an endangered or threatened species, provided these plans minimize harm and do not impair species recovery. The bill also allows for broader exemptions for widespread activities that pose minimal risk, requiring public hearings and input from experts before implementation.
