This bill provides that a parent or caregiver who unlawfully uses, manufactures, or distributes a controlled dangerous substance while in the presence of a child is guilty of the crime of endangering the welfare of that child. The bill provides that any person with a legal duty for the care of a child or who has assumed responsibility for the care of a child who violates the provisions of N.J.S.2C:35-5 while in the presence of such child would be guilty of a crime of the third degree pursuant to N.J.S.2C:24-4, endangering the welfare of a child.
