This bill amends Title XIX of the Social Security Act, which governs the Medicaid program, to exclude drugs specifically designed to deter abuse, known as "abuse-deterrent formulations," from a requirement that drug manufacturers provide additional rebates to Medicaid for new formulations of their drugs. This means manufacturers will not have to offer these extra discounts for abuse-deterrent versions of existing medications. Additionally, the bill creates new protections for "covered algorithms," which are technologies used to identify and prevent waste, fraud, and abuse in programs like Medicaid and Medicare, ensuring that these proprietary algorithms are not subject to public disclosure under the Freedom of Information Act (FOIA) and limiting their use and disclosure by state agencies to program administration and fraud prevention efforts. Finally, it allocates $5 million annually to the Medicaid Improvement Fund starting in fiscal year 2021.
