The District of Columbia Code is amended to declare that nothing in it shall be construed as authorizing the District of Columbia to make any change in law, regulation, or basic procedure and practice relating to the respective roles of the Congress, the President, the federal Office of Management and Budget, and the Government Accountability Office in the preparation, review, submission, examination, authorization, and appropriation of the total budget of the District of Columbia government.
AI Summary
This bill, titled the Clarifying Congressional Intent in Providing for DC Home Rule Act of 2016, aims to clarify the roles of the District of Columbia government and Congress in the local budget process. It repeals the Local Budget Autonomy Amendment Act of 2012, effectively reverting to previous law regarding the District's budget. The bill amends the District of Columbia Home Rule Act to explicitly state that the District's General Fund does not have a continuing appropriation and that all funds for the District must be appropriated annually through the federal appropriations process, meaning Congress must approve the District's budget each year. Furthermore, it clarifies that the District cannot make changes to laws, regulations, or procedures that affect the roles of Congress, the President, the federal Office of Management and Budget (OMB), or the Government Accountability Office (GAO) in the preparation, review, submission, examination, authorization, and appropriation of the District's total budget. This context is important because it addresses a long-standing debate about the extent of the District's autonomy in managing its own finances versus the oversight authority of the federal government.
