This bill, known as the "occupancy of public facilities act," mandates that schools and public agencies designate multiple-occupancy bathrooms and changing facilities for use based on an individual's biological sex, which is defined as the physical condition of being male or female as indicated on a birth certificate or state-issued identification card. This means that restrooms and locker rooms designed for more than one person, where individuals may be undressed, must be assigned to either males or females. While schools and public agencies can still offer single-occupancy facilities or make other accommodations for individuals with special circumstances, they cannot allow someone to use a multi-occupancy facility designated for the opposite biological sex, except in specific situations like custodial work, maintenance, providing medical assistance, accompanying someone needing help, or if the facility is temporarily designated for a different sex. Local ordinances or policies that contradict this act will be considered invalid.
