This bill prohibits state agencies from entering into contracts or agreements with business entities that require any person or public entity to give up any right or remedy provided by the laws of New Jersey, with some exceptions. The term "state agency" includes any principal department in the state's executive branch, as well as any division, board, bureau, office, commission, or other instrumentality within or created by such department, and any independent state authority, commission, instrumentality, or agency. The term "business entity" includes any natural or legal person, business corporation, professional services corporation, limited liability company, partnership, limited partnership, business trust, association, or any other legal commercial entity organized under the laws of New Jersey or any other state or foreign jurisdiction. The bill does not apply to any contract or agreement in effect on the effective date of the bill or to any contract or agreement that is necessary to address a public emergency.
