Bill Summary

This bill would criminalize the manufacture, sale, and possession of 3,4-Dichloro-N-[1R,2R)-2-(dimethylamino)cyclohexyl]-N-methylbenzamide, commonly known as U-47700, or U-4, by adding it to this State's list of controlled dangerous substances. Also known by the street name "Pink," U-4 is a synthetic opioid analgesic drug described as eight times stronger than heroin. According to the Drug Enforcement Administration (DEA), U-47700 acts similarly to morphine in animals, and has not been approved by the Food and Drug Administration (FDA) for human consumption. There are no known currently accepted medical uses in treatment in the United States. Moreover, since 2015, there have been at least 46 confirmed fatalities associated with the abuse of this drug in humans as reported by the DEA. Under the bill, it is a crime of the second degree to manufacture, distribute or dispense U-47700, in a quantity of one ounce or more. It is a crime of the third degree where the quantity is one ounce or less. Further, the bill provides that it is a crime of the third degree to obtain or possess U-47700, in a quantity of one ounce or more. It is a crime of the fourth degree where the quantity obtained or possessed is one ounce or less.
