This bill proposes to amend existing laws concerning the posting of security for animals seized in cruelty cases, defining "authority" as an organization or its agent that impounds an animal. If an animal is seized due to cruelty or fighting and a criminal complaint or indictment is issued, the authority or prosecuting agency can ask the court to order the owner or claimant to post a security. This security amount, determined by the court based on the authority's recommendation, must cover reasonable anticipated and incurred expenses for the animal's care, including medical needs, quarantine, shelter, and board, for at least 30 days. The security must be posted within 10 business days, and failure to do so results in forfeiture of the animal to the authority, though the court can waive or reduce this requirement for good cause. The posting of security does not prevent the humane euthanasia of the animal, and if expenses are not fully covered by the security at the end of the period, the court may order additional security or humane disposal of the animal, with the owner or claimant forfeiting any claim to damages or the animal's value if they failed to post the required security. Any unused portion of the security may be refunded, and refunds are also possible if the charges against the owner are dismissed.
