This bill modifies the provisions relating to the publication of notice for the sale of real estate. The key changes are: 1. The trustee can now choose between two methods to provide the required notice - either through an electronic notice posted for a minimum of 21 consecutive days on an internet website hosted by a Missouri-based entity, or through traditional newspaper publication for at least 20 times in a daily newspaper (for counties with cities of 50,000+ inhabitants) or 4 successive weeks in a weekly newspaper (for other counties). 2. The electronic notice method must be provided by a Missouri-based entity that maintains certain insurance coverage and does not restrict access to the website. The fee for the electronic posting cannot exceed the regular local classified advertising rate of newspapers authorized to carry legal publications in that county. 3. The entity providing the electronic notice must maintain a historical record of each posting for 5 years and issue an affidavit attesting to the dates of posting and compliance with the requirements. 4. If the property is located in multiple counties, the notice must be posted under each relevant county through either the electronic or newspaper publication method. The bill aims to provide trustees with an alternative electronic option to the traditional newspaper publication requirement for providing notice of real estate sale.
