This bill amends North Dakota's laws relating to gross sexual imposition. The key provisions are: 1) It changes the penalty for an offense under the gross sexual imposition law where the victim dies as a result of injuries sustained during the offense. In such cases, the offense becomes a Class AA felony, which carries a maximum penalty of life imprisonment without parole, unless the defendant was a juvenile at the time of the offense. 2) It creates a new section that allows courts to reduce the sentence of a defendant who was convicted as an adult for an offense committed before the age of 18, if certain conditions are met. These include the defendant having served at least 20 years in custody, filing a motion for sentence reduction, and the court finding the defendant is no longer a danger and a sentence modification is in the interests of justice. The defendant would then be required to serve a minimum of 5 years of supervised release upon release from prison.
