This bill amends sections of the North Dakota Century Code to terminate wind option agreements, wind easements, and wind energy leases if certain requirements are not met within five years of their commencement. Specifically, the bill requires that a certificate of site compatibility or conditional use permit be issued and a transmission interconnection request be in process and not under suspension within five years. It also allows the owner of the energy rights to terminate the agreement, easement, or lease if a wind farm facility is not constructed or operated for 36 consecutive months. The bill provides a process for the owner of the energy rights to provide notice and file for termination in such cases.
