This bill creates two new crimes in the New York Penal Law: tampering with electronic monitoring equipment in the second degree and tampering with electronic monitoring equipment in the first degree. Tampering with electronic monitoring equipment in the second degree is a Class A misdemeanor, and tampering with electronic monitoring equipment in the first degree, which occurs when a person also commits a Class A or Class B felony while tampering with the equipment, is a Class E felony. The bill specifies that when a person is convicted of the first-degree offense, the sentence for that crime must run consecutively to any sentence imposed for the underlying Class A or Class B felony.
