Bill Summary

AN ACT RELATING TO HEALTH; AMENDING SECTION 52-3-32.1 NMSA 1978 (BEING LAWS 2009, CHAPTER 252, SECTION 1) TO ADD POSTTRAUMATIC STRESS DISORDER AND MENTAL HEALTH DISORDER TO THE LIST OF DISEASES PRESUMED TO BE PROXIMATELY CAUSED BY EMPLOYMENT AS A FIREFIGHTER.

AI Summary

This bill amends existing law to add post-traumatic stress disorder (PTSD) and other mental health disorders to the list of diseases presumed to be caused by employment as a firefighter. The bill establishes a presumption that if a firefighter is diagnosed with PTSD or a mental health disorder after their employment, the condition is presumed to be related to their work as a firefighter. This presumption can be rebutted by evidence that the firefighter engaged in activities outside of work that posed a significant risk of developing the condition. The bill also provides that medical treatment for these conditions must be provided by the employer as a work-related illness or injury, unless a court determines the presumption does not apply.
