This bill modifies the drug court approval process in Oklahoma. The key provisions are: (1) the district attorney must determine if the offender is eligible and has not been admitted to the drug court program within the last 5 years, and can object to the offender's consideration for the program; (2) if there is no objection, the court will refer the offender for a drug court investigation and set a hearing to determine final eligibility; (3) if the district attorney objects, the court has discretion to review the offender's request and either approve it for the investigation and hearing, or deny it, in which case the criminal case will proceed traditionally; and (4) the bill takes effect on November 1, 2017.
