This bill allows employing brokers, including corporate officers who are designated brokers, to appoint a licensed individual to manage a branch office or a division of their real estate business, delegating responsibilities for daily operations, supervision of other licensees, and clerical staff. This appointed manager would be subject to disciplinary action if they fail to properly supervise licensed activities, as outlined in Section 10165 of the Business and Professions Code, which this bill amends to include violations of the new Section 10164. The appointment must be documented in a written contract, and the employing broker must notify the Department of Real Estate (the "department") of the appointment and any terminations or changes. Certain licensees, such as those with restricted licenses, those who have been debarred, or salespersons with less than two years of experience, cannot be appointed as managers.
