This bill decreases penalties for possession of marijuana and drug paraphernalia in New Mexico. It establishes a penalty assessment of $50 for possession of one ounce or less of marijuana, classifies possession of more than one ounce but less than eight ounces as a petty misdemeanor or misdemeanor, and maintains a fourth-degree felony charge for possession of more than eight ounces. The bill also reduces the penalty for possession of drug paraphernalia to a $50 fine. Additionally, the bill creates a new section in the Criminal Code to provide procedures for issuing and processing penalty assessment citations.
