This bill, the Effective Assistance of Counsel in the Digital Era Act, prohibits the monitoring of the contents of electronic communications between a prisoner in a Bureau of Prisons facility and their attorney or other legal representative. The bill requires the Attorney General to modify any program or system used by prisoners to send or receive electronic communications to exclude the monitoring of the contents of communications between a prisoner and their legal counsel. However, the bill allows for the retention of the contents of these communications and provides an exception where a court can conduct an in-camera review of the communications if there is sufficient evidence to support a reasonable belief that the communications were for the purpose of perpetrating a fraud or crime.
