This bill limits the prescribing power for contact lenses and spectacles (eyeglasses) in New Mexico. It prohibits anyone who is not licensed under the Optometry, Medical Practice, or Osteopathic Medicine Acts from performing eye examinations or writing prescriptions for contact lenses or spectacles. The bill also requires that an in-person eye examination be conducted before writing a prescription, considering any medical findings and refractive errors. Violations can result in misdemeanor or felony charges, and gives the relevant licensing boards and other parties the ability to seek injunctive relief. The bill provides some exceptions, such as allowing healthcare providers to use telehealth for ocular diseases, vision screenings in schools, and eye care screenings at certain events.
