This bill amends the Telecommunications Infrastructure Maintenance Fee Act to clarify that municipalities can require telecommunications carriers to pay a reasonable application fee to gain access to public rights-of-way, even though the Act prohibits new franchise fees or other charges for the use of public rights-of-way. The bill also specifies that the regulation of the terms and conditions for sharing poles, conduits, and other facilities in the public way is under the exclusive jurisdiction of the Illinois Commerce Commission and the Federal Communications Commission, and municipalities cannot enter into contracts or agreements with telecommunications retailers regarding such terms and conditions. The bill takes effect immediately upon becoming law.
