This bill amends the Texas Health and Safety Code to authorize the Texas Commission on Environmental Quality (TCEQ) to regulate prescribed burning, which is the controlled application of fire to vegetation in managed lands. The bill requires the TCEQ to establish rules that allow certified and insured prescribed burn managers to conduct prescribed burns for forest, ranch, wildland, and wildlife management, as well as wildfire hazard mitigation, while limiting the TCEQ's ability to impose certain requirements, such as prescribing the specific methods used to control air contaminant emissions or the timing and atmospheric conditions for the burns. The bill takes effect immediately if it receives a two-thirds vote in the Texas legislature, or on September 1, 2017, if it does not receive the necessary votes.
