This bill aims to ensure driver privacy with electronic tolling. It amends existing law to prohibit the use of toll collection technology, such as radio-frequency identification (RFID) transponders, for purposes other than charging and collecting tolls. The bill also restricts the sharing of data collected through toll collection technology, such as GPS coordinates, date, time, license plate numbers, and other identifying information, with any entity outside the department without a valid warrant. Violation of these provisions can result in civil liability, including exemplary damages and attorney's fees, as well as the inadmissibility of such improperly obtained data in criminal or civil proceedings.
