This bill aims to assist families caring for elders by amending the Massachusetts General Laws to allow for legally and reasonably enforceable fair market value transactions between family members for personal care or managerial services. The key provisions include: (1) the contract must specify the type, frequency, and duration of services, as well as the compensation; (2) the services must enable the applicant or member to avoid or delay nursing home placement or facilitate their return to the community; (3) the compensation must be commensurate with a reasonable wage scale based on the fair market value of the services and the caregiver's qualifications; and (4) any lump sum payment for future services must be refundable if the caregiver cannot fulfill their duties or the applicant/member dies before their life expectancy. The Department of Health and Human Services is required to promulgate regulations to implement this section.
