This bill aims to expedite the transfer of cases to the permit session of the Massachusetts Land Court. The key provisions are: 1. The permit session of the Land Court will have concurrent jurisdiction with the Superior Court over civil actions related to the appeal of municipal, regional, or state permits, orders, certificates, or approvals (or their denials) concerning the use or development of real property, as well as certain related claims. 2. Notwithstanding any other law, any action not originally filed in the permit session but within its jurisdiction can be transferred to the permit session upon a party filing a notice demonstrating compliance with the jurisdictional requirements. The court where the action was originally filed must transfer the case file to the permit session within 20 days, unless the permit session notifies the court within 10 days that the case does not meet the jurisdictional requirements. 3. If a party to an action in the permit session claims a valid right to a jury trial, the action shall be transferred to the Superior Court for a jury trial.
