This bill aims to protect innovation and entrepreneurship in the Commonwealth by addressing bad-faith assertions of patent infringement. It defines key terms such as "assertion of patent infringement" and "demand letter," and outlines factors that a court can consider in determining whether an assertion of patent infringement was made in bad faith. The bill allows targets of such conduct, or persons aggrieved by a violation of the chapter, to bring an action in Superior Court and seek remedies such as equitable relief, damages, costs and fees, and exemplary damages. The Attorney General also has the authority to make rules, conduct civil investigations, and bring civil actions under this chapter.
