This bill amends Section 42 of Chapter 166 of the General Laws to allow municipal lighting plants, upon the request of a public safety official in a city or town with a municipal lighting plant, to remove, move, or relocate any wire, cable, apparatus, or pole belonging to any person or entity. The municipal lighting plant and its employees and contractors would not be liable for any damages arising from such removal, moving, or relocation. Additionally, if the owner of the wire, cable, apparatus, or pole does not respond within two hours to the public safety official's or municipal lighting employee's request to remove, move, or relocate it, and in the case of an emergency, the municipal lighting plant may bill the owner for all costs incurred in effecting such removal, moving, or relocation.
