This bill aims to protect public health during unseasonably warm weather by allowing boards of health or the Department of Public Health to grant a temporary heating variance to landlords. The variance would relieve landlords of the obligation to provide heat when the board or department determines that the outdoor temperatures are unusually warm. The variance can be issued in advance based on weather forecasts and can last up to 96 hours, with the possibility of consecutive variances if the warm temperatures persist. The bill also requires the local board of health to consider issuing a blanket heating variance within 72 hours of receiving a written request from 10 or more residents, owners, or landlords under its jurisdiction.
