This bill amends the existing law in Massachusetts to establish a presumption of shared legal and physical custody of minor children in divorce cases, absent emergency conditions, abuse, or neglect. The bill requires the court to make written findings to support any order for sole legal or physical custody, and it also allows for the modification of parenting schedules based on changes in the availability of parents or the developmental stage of the child. The bill further provides that the failure of the parents to submit a shared custody implementation plan shall not diminish the presumption of joint custody or affect the child's right and the parents' rights to frequent and continuing contact.
