This bill seeks to eliminate disparate impact in civil rights laws. It amends Chapter 12 of the General Laws to prohibit state, county, or local governments from excluding, denying benefits to, or discriminating against individuals based on their race, color, national origin, or sex. The bill allows individuals who have been subjected to such discrimination to file a civil lawsuit within 3 years of the violation. If the court finds a violation, it can award actual and punitive damages, and the prevailing plaintiff can recover reasonable attorneys' fees and costs. The bill defines "prevailing party" broadly to include those who obtain some relief through a judgment, settlement, or whose action prompts the government to change its position.
