Bill Summary
Relative to rent escrow court actions. The Judiciary.
AI Summary
This bill amends the fourth paragraph of Section 8A of Chapter 239 of the General Laws in Massachusetts. It requires that, if a trial date is continued for any reason in a rent escrow case, the court shall order the tenant or occupant to deposit with the court, the plaintiff's attorney, or another secure depository the amounts due for use and occupancy, calculated based on the fair market value of the premises, unless the court determines that such a requirement would cause undue hardship to the tenant or occupant. If the tenant or occupant fails to comply with the deposit order, the court shall schedule the matter for an immediate bench trial and make any other orders it deems appropriate.
