This bill expands the individuals authorized to perform marriage ceremonies in Massachusetts. The bill amends existing law to clarify that any individual who certifies the performance of a marriage ceremony by executing a Notice of Intention is presumed to have the authority to do so, and that the marriage performed by such individual is presumed valid and enforceable. Additionally, the bill allows the municipal clerk where the Notice of Intention is filed to designate any other person to solemnize a particular marriage upon application, and the clerk can revoke such designation for cause. The clerk must issue a certificate of designation to the person upon payment of a $25 fee, which can be waived for good cause.
