This bill amends Chapter 127 of the General Laws to authorize the release of terminally ill inmates to alternative locations of confinement outside of correctional facilities, jails, or houses of correction. The key provisions allow the Commissioner of the Department of Correction or a Sheriff to petition the court for an order to release a terminally ill inmate to a community confinement monitoring program where the inmate can receive appropriate medical care, such as at a hospital, nursing facility, or licensed hospice program. The bill also gives the Commissioner or Sheriff the authority to terminate the inmate's participation in the program if the inmate fails to comply or if their medical condition improves and they are no longer deemed terminally ill.
