This bill creates the offense of "possession of a firearm while under the influence of alcohol or a controlled substance." The bill makes it a Class A misdemeanor to knowingly possess a firearm while under the influence to the degree that the person is incapable of safely operating the firearm. The bill also allows law enforcement to request a person to submit to testing to determine the presence of alcohol or controlled substances, and failure to submit to such testing can result in a civil penalty. Additionally, the bill amends existing law to prohibit someone convicted of this new offense from obtaining a concealed carry license for three years for a first offense, or permanently for a second offense.
