This bill amends the Massachusetts General Laws to allow for the establishment of minority and women-owned business enterprise (MBE/WBE) participation goals on certain public construction projects. The bill applies to projects procured by the Division of Capital Asset Management and Maintenance, the Massachusetts State College Building Authority, the University of Massachusetts Building Authority, and the Massachusetts Port Authority, as well as any state-assisted building project with an overall estimated cost of $5 million or more. The bill permits filed sub-bidders and trade contractors to subcontract portions of their work to meet the MBE/WBE participation goals, provided that the total value of the subcontracted work does not exceed the goal by more than an additional 10 percent. The bill also requires the Commissioner to establish a process for filed sub-bidders and trade contractors to request a reduction or waiver of the participation goals.
