This bill amends Massachusetts law to create a new offense of "organized retail crime by flash mob." Specifically, it defines organized retail crime by flash mob as the act of six or more persons, acting in concert, stealing retail merchandise cumulatively valued at more than $500 while making electronic communications to coordinate the theft. The bill also establishes a new offense of being a "leader of an organized retail theft enterprise," which carries more severe penalties, including fines of up to $250,000 or five times the retail value of the stolen merchandise, and imprisonment of up to 20 years in state prison.
