AI Summary
This bill amends Chapter 266, Section 30 of the law to increase the penalties for unlawfully obtaining possession or control of the property of an elder (aged 60 or older) or a person with a disability, if the value of the property exceeds $1,000. The new penalty is up to 5 years in state prison or 2.5 years in a house of correction, and/or a fine of up to $25,000. If the property is an interest in real estate, the penalty is up to 10 years in state prison or 2.5 years in a house of correction, and/or a fine of up to $50,000. The court may also order restitution to the victim, regardless of the property's value. Additionally, the consent of the owner is not considered voluntary if a caretaker is involved, unless the caretaker's consent is witnessed in writing, and the caretaker cannot witness the consent if they intend to benefit from the property transfer.
